HB1669 – EDIBLE VACCINES

This bill specifies that any product that acts as, or exposed to processes that could result in the product potentially acting as, a gene therapy or that could possibly impact, alter, or introduce genetic material or a genetic change into the user of the product or certain other people must be conspicuously labeled with the words “Potential Gene Therapy Product”, and reasonable steps must be taken to ensure a potential purchaser or user is made aware of the presence of this label. If a product is known to be a gene therapy product, the product must be conspicuously labeled with the words “Gene Therapy Product”.

Upon the written request, any entity that produces, sells, or distributes a product with the capacity to infect an individual with a disease or to expose an individual to certain genetically modified material must provide all information related to the ways in which individuals who did not directly obtain or use such product may be exposed to the product or a component of the product. Any product manufacturer, government agency, or organization that has an interest in the production, sale, or distribution of such a product is also subject to the disclosure requirement and must provide all relevant reports, research, and knowledge upon request. Information requested must be provided as soon as reasonably practicable, but at least within 21 days, after receipt of the written request.

Any entity that makes a product available that could infect, transmit to, or be absorbed in any way that would act as a medical intervention, vaccine, drug, or genetic modification must obtain fully informed consent from all individuals who could be exposed to such product before exposure may occur. Fully informed consent requires, at a minimum, that an individual is made aware of all benefits and risks, including side effects, of the product, any adverse events of special interest, and any other reasonably possible impacts of the product.

Child Protection in Public Schools; Defining the term “sex”; prohibiting an employee, contractor, or student of a public school from being required to refer to a person using personal titles or pronouns that do not correspond with that person’s sex; prohibiting classroom instruction by school personnel on sexual orientation or gender identity until grade 9; providing that materials used to teach reproductive health or any disease as part of certain courses must be approved by the Department of Education; requiring district school boards to adopt and publish a specified process relating to student access to certain materials, etc.

Gay and Transgender Panic Legal Defenses; Prohibits individuals from using nonviolent sexual advance or specified perceptions or beliefs about another individual as criminal offense or to mitigate severity of offense.
 
PROHIBITION ON GAY AND TRANSGENDER PANIC LEGAL
DEFENSES.—A nonviolent sexual advance or the perception or belief, even if inaccurate, of the sex, sexual orientation, gender expression, or gender identity of an individual may not be used as a defense to a criminal offense, to excuse or to justify the conduct of an individual who commits a criminal offense, or to mitigate the severity of a criminal offense during sentencing.

Employer Coverage of Gender Dysphoria Treatment; Citing this act as the “Reverse Woke Act”; requiring employers that provide coverage of gender dysphoria treatment to also cover the full costs associated with treatment that reverses such gender dysphoria treatment, regardless of the rate of coverage provided for the initial treatment; prohibiting employers from making coverage of the subsequent treatment contingent on whether the employee receives such treatment in this state; creating a right of action for aggrieved persons to recover actual total costs and damages from an employer or former employer, as applicable, under certain circumstances, etc.

Employer Coverage of Gender Dysphoria Treatment; Requires employers that provide coverage of gender dysphoria treatment to also cover full costs associated with treatment that reverses such gender dysphoria treatment, regardless of rate of coverage provided for initial treatment; provides that employees who receive such treatment through coverage provided by employer are entitled to coverage of total costs associated with treatment, regardless of whether they are still employed by that employer; prohibits employers from making subsequent treatment contingent on where treatment is received; creates right of action for aggrieved persons to recover actual total costs & damages from employer or former employer.
